Abstract:

Physician-Assisted Suicide is an important, challenging issue in medical ethics, which the right to die is a central point in this issue. Physician-Assisted Suicide is offered to end intolerable pain and suffering. Although, it is a legal practice in some countries, still it is a challenging and controversial practice in ethical and legal perspectives. It has been argued that based on the principles of medical ethics, physicians should respect patient’s decision, however many ethicists and jurists believe that Physician-Assisted Suicide is unethical. It should be noted that the main reason for proponents and opponents is based on their interpretation about human dignity. This controversy can be resolved by reference to religious interpretation of human dignity in which asserts that Physician-Assisted Suicide is against human dignity and respect for human life.

Background: In the majority of countries, active direct euthanasia is a forbidden way of the deprivation of the pa-tients’ life, while its passive form is commonly accepted. This distinction between active and passive euthanasia has no justification, viewed through the prism of morality and ethics. Therefore, we focused on attention on the moral and ethical implications of the aforementioned medical procedures. Methods: Data were obtained from the Clinical Hospital Center in Kragujevac, collected during the first half of the 2015. The research included 88 physicians: 57 male physicians (representing 77% of the sample) and 31 female physi-cians (23% of the sample). Due to the nature, subject and hypothesis of the research, the authors used descriptive me-thod and the method of the theoretical content analysis. Results: A slight majority of the physicians (56, 8%) believe that active euthanasia is ethically unacceptable, while 43, 2% is for another solution (35, 2% took a viewpoint that it is completely ethically acceptable, while the remaining 8% considered it ethically acceptable in certain cases). From the other side, 56, 8% of respondents answered negatively on the ethical acceptability of the physician-Assisted Suicide, while 33% of them opted for a completely ethic viewpoint of this procedure. Out of the remaining 10, 2% opted for the ethical acceptability in certain cases. Conclusion: Physicians in Serbia are divided on this issue, but a group that considers active euthanasia and physician-Assisted Suicide as ethically unacceptable is a bit more numerous.

Abstract:

One of the most important and controversial issues in medical law is “Physician Assisted Suicide” that during the recent decades, it has been a challenging issue among the jurists, criminologists, doctors and even the patients themselves, as a part of the vulnerable population of society. This subject has had its own supporters and opponents. Core of these disputes is the “Right to Die” for the patients. From the perspective of criminal law doctrines, there is a significant difference between the Euthanasia and the above mentioned subject, from the view of doctor’s direct or indirect participation in the patient’s death; which means that doctor is involved in euthanasia directly and provides assistance in the physician Assisted Suicide. In other words, in direct participation, “doctor” does the actus reus of murder, but in indirect participation, she only helps the “patient” to kill himself. In criminal policy of Iran, Suicide is not permissible under the influence of religious and juridical doctrines, but has not been criminalized, and therefore it concluded that assistance in Suicide should not be considered criminal. Nevertheless, the legislator of Iran has criminalized aiding and facilitating Suicide through the computer systems, telecommunication systems or data carriers, as an independent crime. This article has criticized and analyzed the foundations of criminalization of this issue, as well as, the methods of penal reaction of Iranian legal system toward this problem; and finally has proposed that criminalization of “Physician Assisted Suicide” as an independent crime in order to respect human life and prevent deviant act of Suicide.

Abstract:

Background: Assisted hatching techniques are utilized to facilitate the embryo escape out of the zona pellucida and increase the pregnancy rates in IVF centers. The objective of this study was to evaluate if Assisted hatching improved the rates of pregnancy for in-vitro fertilization, in Isfahan Infertility Center.Materials and methods: This case-control study was carried out on 296 infertile patients. Patients with Assisted hatching were 131 (case group) and non-treated patients were 165 (control group). Patients' age, number of oocytes aspirated, number of oocytes fertilized, and numbers of embryos transferred were matched. The pregnancy was determined by positive b-HCG, 14 days after transfer; and implantation was defined as presence of gestational sac in uterus on sonography. Statistical analysis was done with the student t-test and X2 test. A Pvalue of less than 0.05 was considered statistically significant. Results: No significant difference was noted in the mean age of patients, the number of oocytes aspirated, the number of oocytes fertilized, and the number of embryos transferred between the case and control groups. In addition, no significant difference was observed in the rates of pregnancy between the hatched and control groups (22.9% versus 20.6%, respectively). Conclusion: Assisted hatching has no significant impact on pregnancy rates in the patients population studied. Further data are needed to determine if Assisted hatching has beneficial effect on pregnancy rate.
